Terms and Conditions Licenses Software purchased for installation on ddavis.com systems shall be licensed under the conditions listed below. The conditions listed below amend or replace the terms of any other license agreement, whether provided with the purchased items, provided online, provided by mail or other message delivery or provided in any fashion or by any means. Any license agreement or similar terms shall be construed in such a manner as to be most beneficial to and least restrictive of the activities of the owners or users of ddavis.com systems. Where the software is provided as a boxed or otherwise packaged product in any commercial establishment (online or in the "real" world), the transaction is a purchase of the product in the package including a license to use the product in the package. Other terms on or in the package which characterize the purchase as something else have no effect. There are no limits on the number of installations of the product. License terms which limit the number of installations in any fashion are invalid. The product is considered to be usable "out of the box" -- if the product fails to function properly, the seller and the manufacture agree to pay the purchaser $100 per hour, with a two-hour minimum charge ($200) per incident, for time spent online or on the telephone in efforts to make the product function properly.
